Setster respects your privacy and values your trust, and committed to ensuring that the privacy of the information stored by our systems is suitably protected and used appropriately.
This Privacy Statement outlines how Setster will treat information gathered by our Websites or hosted within our applications. By using these Services, you agree to comply with and be bound by this Privacy Statement and the Terms and Conditions of Use published at www.setster.com/terms.

'Personally identifiable information' (PII) as used in US privacy law and information security, is information that can be used with other information to identify, contact, or locate a single person, or to identify an individual in context. Under California SB 1386 and AB 1298 "personal information" means an individual's first name or first initial and last name in combination with any one or more of the following data elements, when either the name or the data elements are not encrypted: (1) Social security number. (2) Driver's license number or California Identification Card number. (3) Account number, credit or debit card number, in combination with any required security code, access code, or password that would permit access to an individual's financial account. (f) For purposes of this section, "personal information" does not include publicly available information that is lawfully made available to the general public from federal, state, or local government records.
"Services" shall refer to the Websites, Services, Applications, Widgets, and scheduling features offered within Setster.
"Business User" shall refer to any business that willingly registers (Subscribes) to use or try the Setster Services, whether paid or unpaid for online scheduling and appointment management purposes.
"Consumer" shall refer to an end consumer using the Services to schedule or modify appointments, provide feedback or submit a review, or utilize any other aspect of the Services that is offered by the Business User using the Setster Services.
"Visitor" shall refer to any person or device that connects to Setster's Website and Services as whole.
"You" shall refer to Consumers, Business Users and Visitors.
"Website" shall refer to Setster website located at www.setster.com and any subdomains as a whole.
Unless permission is provided through our Opt-in process, we will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by Setster will only be in connection with the provision of agreed services, products or inquiries.
We may also ask Business Users to provide a valid credit card number and billing address so that we can process any payments for use of the Services by such Business User. Online credit card payments related to Setster Subscriptions are processed by a PCI certified payment processing vendor utilizing secure, encrypted payment card processing methods. Financial information will not be shared with any party not directly involved with billing of the services. All transactions are processed through this payment processing vendor and are not stored on the Setster servers.
The Setster Service collect data in order to schedule services on behalf of Business Users. As a function of the application, Business Users may customize the data that is collected from Consumers. Typically, the data collected is: First & Last Name, Email Address and Telephone number. Pursuant to best practices and privacy regulations, Business Users should limit the amount of personally identifiable information collected to only that which is strictly necessary.
The Service may also facilitate the collection of credit card information from Consumers in circumstances where a Business User has decided that it requires such information to be collected from Consumers scheduling appointments with it through the Services. These credit card payments are processed by a PCI certified payment processing vendor utilizing secure, encrypted payment card processing methods and is only available if the Business Users sign up to use the payment processors services. Payments are made directly to the Business User's account with these payment vendors and Setster is not involved with these transactions. All transactions are processed through this payment processing vendor and are not stored or processed on the Setster servers.
We may also collect user submitted information including but not limited to ratings & reviews of Business Users with whom the submitting Consumer has interacted through the Services, and any responses or other postings by a Business User.
You should be aware that if you upload, post, and/or distribute to the Services material, including but not limited to, Personally Identifiable Information, questions, feedback, reviews, data, comments, ratings, suggestions, information, text, data, software, sounds, photographs, podcasts, audio, audiovisual, video, images, graphics, messages and other content or materials of any nature ("User Submitted Materials"), those materials and the substantive information contained in them may be accessible by the public and third parties. The activities of third parties are beyond the control of Setster. Please do not post any information that you expect to keep private on the Setster website or in other areas of the Services.
Setster classifies all scheduling and appointment information as confidential and proprietary to the Business User. Setster will not share a Business User's appointment data with any third party outside the scope of Setster Services. For Consumers scheduling appointments with a Business User, Setster will not share the scheduling information with anyone except the Business User with whom they are making an appointment. A Business User can only view information relating to their instance of Services.
If a Consumer chooses to use the Service, the Consumer may elect to provide information including, but not limited to, that Consumer's name, telephone number, and email address (collectively "Consumer Information"), that may or may not be Personally Identifiable Information.
We do not intentionally provide PII to third parties except where you provide information when scheduling an appointment through the Services, when registering to use the Services as a Business User, or to indicate interest in services advertised by one of the businesses bookable through the Services. In any of the above situations, we may provide that information to the appropriate Consumer, Business User or advertiser so that they may attempt to schedule an appointment or provide you with information regarding the advertised products or services about which you inquired.
If a Consumer provides any Consumer Information or User Submitted Materials to the Services that are relevant to a Business User with whom that Consumer schedules an appointment or otherwise transacts through the Services, Setster reserves the right to provide such Business User with the relevant Consumer Information and/or User Submitted Materials for purposes of managing the appointment and/or transaction with such Consumer, whether or not such information is Personally Identifiable Information.
Information and User Submitted Materials provided by a Business User on its profile or elsewhere on the Services will be accessible by Consumers and the public. Information and User Submitted Materials provided by a Consumer, including any personally identifiable information provided when such Consumer schedules an appointment through the Services, will be made available to the Business User with whom the Consumer is scheduling an appointment.
Non-personally identifiable information is information that, by itself, cannot be tracked to a specific individual. Examples of non-personally identifiable information include, but are not limited to, the type of internet browser you are using, the type of computer operating system you are using, your IP address, the time and date of your use of the Services, and whether or not you clicked on hypertext links within the Services. We may collect non-personally identifiable information while you use the Services.
We may use the non-personally identifiable information to generate user statistics that we may provide to prospective advertisers or partners. If we provide any such information to others, we will provide such information in the aggregate only and will not include any personally identifiable information about any individual users. We may also use the non-personally identifiable information to generate statistics that we may provide to you and to other businesses using the Services, including, for example, the number of appointments in a certain time period. We also may provide non-personally identifiable information to contractors so that they can perform services for us.

We may use such information to send you email messages and other notifications relating to the Services and your use of the Services. We reserve the right to notify you through e-mail, facsimiles, text or voice messages, or notices posted on the Setster websites. By using the Services, you consent to receiving such notifications.
Business Users may opt-out of receiving notifications regarding appointments through the Services by logging into their Setster account and changing the notification settings; opting-out of such notifications, however, will limit the effectiveness of the Services. Notwithstanding the foregoing, neither Business Users nor Consumers may opt-out of receiving notifications relating to support of the Services or other notices as required by law.
In the event that we, in whole or in part, establish a partnership with another company, or are acquired by or merged with another company, information we collect may be transferred to the partner or the acquiring or merging company at time such merger, acquisition, or partnership is closed and to the extent necessary to fulfill our obligations under such merger, acquisition, or partnership.
Setster employees may periodically access Business Users data solely for administrative purposes, application support, or to improve systems efficiency and add enhancements.
If you enter in a service request that requires us to troubleshoot your account, our support team may access your account. Likewise, if your account needs custom configuring and set-up, our team will log into your account from our back-end using your user ID to configure the account.
When it comes to the collection of personal information from children under 13, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation's consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.
Children should request permission from their parent or guardian prior to sending personal information online. Setster does not intentionally collect any personally identifiable information from individuals under the age of 13. No part of Setster Website is structured to attract anyone under the age of 13. If a child has provided Setster or a Setster Business User with personally identifiable information via the Service and the parent or guardian would like this information removed from the Business Users data, the parent or guardian of that child should contact the Business User and ask that the data be removed from their records. If further assistance is needed, contact Setster directly at email@example.com and we will use reasonable efforts to assist in the deletion of the child's personally identifiable information.
Other websites and applications not under the direct control of Setster are not governed by this Privacy Statement. Emails generated by Business Users as part of the Setser services may contain links to enable Consumers to visit other websites. Be aware that Setster does not have any control over the target website and cannot be responsible for the protection and privacy of any information that a User provides while visiting them. Caution should be exercised when visiting unknown websites, and the privacy statement applicable to the website in question should be reviewed prior to use.
Setster has a team dedicated to keeping your information secure and testing for vulnerabilities. We also continue to work on features to keep your information safe. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive information you supply is encrypted via Secure Socket Layer 128-bit SSL. Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.
Setster retains information you store on our Services for as long as we need it to provide you the Services. If you delete your account, we'll also delete this information. But please note: (1) there might be some latency in deleting this information from our servers and back-up storage; and (2) we may retain this information if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.
We have implemented commercially reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure, but we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes. We cannot ensure the security of any information transmitted to us over the Internet, and we accept no liability for any unintentional disclosure of such information. You acknowledge that you provide your personal information at your own risk and that you're not obliged to do so.
